Twitter, Facebook and WhatsApp Appeal Fines for Refusing to Localize User Data in Russia

Twitter, Facebook and WhatsApp have appealed the decisions, according to which they must pay fines for refusing to localize databases of Russian users in the Russian Federation.


This was reported in the Telegram channel of the Moscow courts of general jurisdiction with reference to the press service: " Twitter, Facebook and WhatsApp have appealed against the rulings of the magistrate 422 of the court district of the Tagansky district of Moscow, which imposed administrative fines on them totaling 36 million rubles ."

The companies were fined by the Tagansky District Court of Moscow on August 26. Twitter and Facebook received fines in the amount of 17 and 15 million rubles, respectively, on charges of repeated violation of the requirements for storing data of Russian users (part 9 of Art. 13.11 of the Administrative Code). In turn, WhatsApp was brought to administrative responsibility for this offense in the Russian Federation for the first time (part 8 of article 13.11 of the Code of Administrative Offenses of the Russian Federation), the amount of the fine for it was 4 million rubles.

According to the amendments to the Law "On Personal Data", which came into force on September 1, 2015, the personal data of Russian users must be stored on the territory of the country.

Facebook, WhatsApp and Twitter, like other foreign companies, did not comply with the legal requirement to confirm the localization of databases of Russian users in Russia. The first fines in the amount of 4 million rubles. Twitter and Facebook received in February 2020. At the end of July 2021, a fine for refusing to localize the data of Russian users was also issued to Google.
